Summary: The system of trail by jury is the product of American law. It's history has been traced since the early development of England. During the 18th and 19th century, The Code Of Napoleon was a factor to our influence of American law. A month before the Declaration of Independence, there was a clause that stated "the legislative, executive and judiciary departments of the State shall be separate and distinct, so that neither exercise the powers properly belonging to the other." As a result this was adopted by many other states as well.
